1. Acceptance of Terms

By accessing or using EMD Striker ("Service"), operated by ADE Marketing Solutions Sdn Bhd ("Company," "we," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

EMD Striker is an EMD opportunity discovery and SERP analysis platform designed to help users identify opportunities for exact match domains (EMDs) in local SEO markets. The Service includes:

  • Keyword discovery and research tools
  • SERP analysis and Striker Score calculation
  • Domain availability checking
  • AI-powered insights and recommendations

3. Account Registration

To use certain features, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credit System and Payments

4.1 Free Features

EMD discovery (5 searches/day for free users), search volume data, and domain availability checks are provided at no additional cost.

4.2 Paid Features

Striker Score analysis requires credits, which can be purchased through our platform:

  • Credits are non-refundable once purchased
  • Credits do not expire
  • Each Striker Score analysis costs 1 credit
  • Prices are in USD and subject to change with notice

4.3 Payment Processing

Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store credit card information.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Use automated scripts to access the Service (except via our API, if available)
  • Resell or redistribute Service data without permission
  • Interfere with or disrupt the Service
  • Violate any applicable laws or regulations
  • Use the Service to spam or send unsolicited communications

6. Data Accuracy and Limitations

While we strive to provide accurate data, we cannot guarantee the accuracy, completeness, or timeliness of information provided by our third-party data sources (DataForSEO, Namecheap, etc.).

  • Search volume and CPC data are estimates from Google Keyword Planner
  • SERP data reflects a point-in-time snapshot and may change
  • Domain availability is checked in real-time but may change before registration
  • Striker Scores are algorithmic assessments, not guarantees of ranking success

7. Intellectual Property

The Service, including its design, features, and content, is owned by ADE Marketing Solutions Sdn Bhd and protected by intellectual property laws. You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer or decompile any part of the Service
  • Remove any copyright or proprietary notices
  • Use our trademarks without written permission

8. User Content

Any data you submit to the Service (search queries, domains analyzed) remains your property. By using the Service, you grant us a limited license to process this data as necessary to provide the Service.

9. Third-Party Services

The Service integrates with third-party services. Your use of these services is subject to their respective terms:

  • DataForSEO (keyword and SERP data)
  • Namecheap (domain availability and registration links)
  • Stripe (payment processing)
  • Google Gemini (AI analysis)

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. Use of the Service is at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADE MARKETING SOLUTIONS SDN BHD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless ADE Marketing Solutions Sdn Bhd and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination:

  • Your right to use the Service immediately ceases
  • Unused credits are non-refundable
  • We may delete your account data after 30 days

14. Governing Law

These Terms shall be governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Kuala Lumpur, Malaysia.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
